Terms & Conditions of Our Website

http://www.sheabodyworks.com), you agree to be and are bound by these terms and other applicable policies. Shea BODYWORKS reserves the right to change these Terms from time to time so we advise you read through them each time that you use the site. If you purchase products from our site, our Terms and Conditions of Sale will apply to your purchase. If you do not agree with these terms and conditions, you should not use our website.

Acceptance of Your Order

When you order on our website, you are submitting to us a binding offer to purchase the products in your cart for personal usage or consumption, and Shea BODYWORKS will do its utmost to fulfill this order to the service levels you expect. Orders can be reviewed and amended before purchasing so you should ensure that you have checked the order thoroughly before submitting it to us. Please note it is not possible to amend an order once it has been submitted. You will receive an Order Confirmation from us via e-mail which will be sent to the email address of the account holder. This Order Confirmation email acknowledges that Shea BODYWORKS has received your order but does not constitute its acceptance of the order.

Shea BODYWORKS will take an authorization from your payment method when you place your order to ensure that you have sufficient funds in your account (in line with its Privacy Policy). If you are paying by PayPal, payment will be taken at the time the order is placed.

Acceptance of orders is at our discretion. When products are shipped, you will receive an e-mail confirmation and at the point of receipt of shipment slip, only then will the Contract be formed, and the Contract will relate only to those products detailed in the Shipment Confirmation. Shea BODYWORKS will inform you if an item you have tried to order is out of stock.

Any products on the same order that Shea BODYWORKS has not yet confirmed via email will not form part of that contract and will form part of a separate contract when the remaining products have been shipped, are ready for collection or, in respect of any services, begun. Placing an order does not constitute a contract with us until Shea BODYWORKS confirms the products as shipped, ready for collection or services begun.

Shea BODYWORKS reserves the right not to accept your order for any reason whatsoever, including, but not limited to, payment problems, product availability and product price or description error.

Your Status

Orders through our website and over the phone can only be placed if you are at least 18 years of age; are legally capable of entering into binding contracts; and you are a 'consumer' (being an individual purchasing the products outside the course of his or her business or trade). All items you order are to be for your own private and domestic use and strictly not for resale. You confirm and agree not to use any products for commercial, business or re-sale purposes when purchasing from us.

Warranty

Shea BODYWORKS warrants each of its products purchased pursuant to these terms to be free of defective material and workmanship under proper use and application. Except as specifically provided in this or a written warranty statement provided with the products, SHEA BODYWORKS MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES AND ALL OTHER WARRANTIES ARE SPECIFICALLY EXCLUDED, INCLUDING ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR PARTICULAR OR SPECIAL PURPOSES. SHEA BODYWORKS SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES REGARDLESS OF THE CAUSE. Shea BODYWORKS’s sole liability shall be discharged by replacing any product which may prove defective under normal and proper use, within the effective period of the warranty, if shown to be defective by proper evidence submitted to Shea BODYWORKS.

Promotional Codes

Once an order has been placed, you cannot go back and apply a promotional code to your order. If you incorrectly apply the promotional code when placing an order, Shea BODYWORKS will be unable to reimburse you the discount once the order has been placed. If you are having any difficulties in applying a promotional code or believe the code to be faulty, please contact our customer services team at saidah@sheabodyworks.com.

Payment Problems

If, for any reason, there is a problem with collecting payment from your credit / debit card or other chosen payment method after Shea BODYWORKS has confirmed receipt of your order, Shea BODYWORKS will not be obliged to ship your order. Additionally, on some occasions, Shea BODYWORKS may be unable to process an order. This may be due to: the item being out of stock or no longer available, your payment being declined, our identification of a pricing error or product description error or an unspecified technical error. If you are sure you are using a valid form of payment, please try again or use a different payment method.

Delivery & Shipping

NOTE: Shea Butter, the main ingredient in our products, has a very low melting point, so if you receive our product in the warm months in a slightly soft or melted state, place jar in a cool place until it returns to its solid state. Also, the performance of the product will not be affected by its appearance.

Free Shipping: You receive free shipping on orders of $45.00 or more via USPS First Class. No coupon code is necessary. 

Risk in the products (e.g., damage or loss to the products) will remain with us until Shea BODYWORKS delivers the products to the address specified in your order or they are collected in store when the risk will pass to you immediately.

Provided you have notified us within 15 days, and the return also meets the terms of our returns, exchanges and refund policy, you will be entitled to a full refund including delivery charges if applicable. Shea BODYWORKS is unable to provide a refund of the delivery charges when only part of your order is being cancelled. Please see Cancellations for more information.

Cancellations

Due to orders being shipped promptly, Shea BODYWORKS is unable to cancel orders after you have received your order confirmation email.

If your order has already been sent out, you may still cancel your order, and to do so, simply return your order to us within 14 working days marking the returns code on your shipment slip as cancelled. Otherwise, you should follow our online refund policy.

Provided you have notified us on the shipment slip that you wish to cancel your order, and the return also meets the terms of our returns, exchanges and refunds policy, you will be entitled to a full refund, excluding delivery charges. Shea BODYWORKS is unable to provide a refund of the delivery charges where only part of your order is being cancelled.

If you wish to return your order outside of the cancellation time period specified above, please refer to our returns, exchanges and refunds policy.

Returns, Exchanges and Refunds

At Shea BODYWORKS, we are very confident in the quality and freshness of our skin care products and know that you will enjoy using them. If for some reason you are not happy with our products, we will gladly refund your money minus shipping or exchange the product within 15 days of purchase. Shea BODYWORKS stands behind all of its products and customers are the number one priority.

Nothing in these terms and conditions affects your legal rights as a consumer in respect of products which are faulty or not as described.

With products purchased as part of a promotional offer or discount, the refund will be amended to reflect any failure to meet the original promotional requirements as a result of returning the product.

Items should be returned to us within 14 days of purchase. All items must be returned to us in the same condition you received them, and Shea BODYWORKS may have a right of action against you for compensation if you do not comply with this obligation. All items returned are at your own risk so please ensure sure you obtain a 'proof of post' from your Post Office or shipping agent.

All products returned to us are examined and refunds to which you may be entitled will be processed as soon as possible. You will not hear from us unless there are any problems.

Refunds will be processed using the same method originally used by you to pay for your purchase. Exchanges will show on your account as a refund of the original product and a purchase of the new product – you will therefore see these as two transactions on your account.

Events Beyond Our Reasonable Control

Shea BODYWORKS will not be held responsible for any delay or failure to comply with its obligations under these conditions if the delay or failure arises from any cause that is beyond its reasonable control, including, but not limited to changes arising out of weather conditions or other force majeure events that delay delivery. This condition does not affect your statutory rights.

Written Communications

With the majority of communications relating to orders made on our site or over the phone mainly coming through electronic means, including email, Shea BODYWORKS may contact you by e-mail or provide you with information by posting notices on our website. You agree to this electronic means of communication and acknowledge that all contracts, notices, information and other communications that Shea BODYWORKS provides to you electronically comply with any legal requirement that such communications be in writing.

In the case of notice being given to the email address provided, it will be deemed received and properly served 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

All written notices given by you to us must be given to Simply Saidah's LLC, 4000 West 106th Street, Ste. 125-130, Carmel, Indiana 46032, U.S.A. or by emailing us at saidah@sheabodyworks.com.

Waiver

If you breach these conditions and we take no action, Shea BODYWORKS will still be entitled to use its rights and remedies in any other situation where you breach these conditions.

Law

This Agreement will be governed by the laws of the State of Indiana, USA, excluding its conflicts of laws principles.  The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. All contracts are conducted in English.

Severability

If any of these terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these terms shall remain in full force and effect.
